Rights and obligations of a natural gas consumer

A consumer who is not a household consumer has the right, in particular, to:

  • free choice of supplier;
  • free change of the supplier, except for the cases provided for in the second paragraph of the first part of Article 14 of the Law of Ukraine "On the Natural Gas Market";
  • obtaining information about the general terms of delivery (including prices), the rights and obligations of the supplier and the consumer, indication of legislative acts that govern the relationship between the supplier and the consumer, available ways of pre-trial resolution of disputes with the supplier;
  • Obtaining natural gas of the proper quality and quantity, the physical and chemical parameters of which comply with the established standards, in accordance with the terms of the concluded contracts, except in cases of termination (restriction) of natural gas supplies in accordance with the requirements of the legislation and the terms of the contracts;
  • free receipt of information on the volumes and other indicators of own consumption of natural gas;
  • Early termination of the supply contract, if the supplier has notified the consumer of the intention to amend the supply contract in terms of delivery conditions and the new delivery conditions turned out to be unacceptable for him.
  • for the simultaneous conclusion of several contracts for the supply of natural gas, if its annual volume of natural gas consumption exceeds 30 million cubic meters. meters;
  • to receive information about natural gas supplier prices and payment procedures free of charge;
  • independently stop (restrict) the extraction of natural gas for own needs in compliance with the requirements of the current legislation, of which he must notify in writing all subjects of the natural gas market with whom the relevant agreements have been concluded;
  • to demand the resumption of natural gas supplies in the prescribed manner after the elimination of violations and compensation for payment for services for disconnection and connection, if the gas supply was interrupted without terminating the natural gas supply agreement;
  • Other rights provided by applicable law.

A consumer who is not a household consumer is obliged, in particular:

  • conclude an agreement on the supply of natural gas;
  • ensure timely and full payment of the cost of natural gas in accordance with the terms of the supply agreement;
  • prevent unauthorized extraction of natural gas;
  • ensure unhindered access of authorized representatives of the gas transmission system operator, gas distribution system operator to natural gas metering stations and in order to establish gas metering stations;
  • stop (limit) the consumption of natural gas in accordance with the requirements of the law and the terms of contracts;
  • ensure compliance with the discipline of selection (consumption) of natural gas in the volumes and on the terms determined by the agreements;
  • implement a set of measures aimed at preventing the occurrence of a threat to life or injury, damage to equipment and products, negative environmental consequences, etc.
  • to independently limit (stop) the consumption of natural gas in the following cases:
  • violation of the terms of payment under the contract for the supply of natural gas;
  • absence or insufficiency of a confirmed volume of natural gas allocated to the consumer;
  • exceeding daily allowance and/or monthly confirmed volume of natural gas without agreement with the supplier;
  • absence of a concluded contract for the supply of natural gas;
  • In case of violation or failure to fulfill its obligations, the consumer is liable under the law.

General conditions for the supply of natural gas

The supply of natural gas to the consumer is carried out on the basis of a contract for the supply of natural gas between the supplier and the consumer, which is concluded in accordance with the requirements of the Rules for the supply of natural gas (approved by Decree NEURC N2496 of September 30, 2015) and after the consumer is included in the Supplier's Consumer Register in the information GTS in the corresponding billing period.

General conditions for the supply of natural gas

The supply of natural gas to the consumer is carried out on the basis of a contract for the supply of natural gas between the supplier and the consumer, which is concluded in accordance with the requirements of the Rules for the supply of natural gas (approved by Decree NEURC N2496 of September 30, 2015) and after the consumer is included in the Supplier's Consumer Register in the information GTS in the corresponding billing period.

The natural gas supplier undertakes:

  • Ensure a continuous supply of natural gas in the manner and on the terms stipulated by the supply agreement;
  • ensure the proper quality of the provision of natural gas supply services in accordance with the requirements of the current legislation and the supply agreement;
  • calculate and issue invoices to the consumer for the supplied natural gas in accordance with the requirements stipulated by the supply agreement;
  • provide household consumers with information provided for by the Law of Ukraine "On the peculiarities of access to information in the areas of supply of electric energy, natural gas, heat supply, centralized supply of hot water, centralized drinking water supply and drainage", in particular, on the price of natural gas, the procedure for paying for consumed natural gas, the rights and obligations of a household consumer, data on actual charges (volume and cost) for gas supply services and other information in accordance with the requirements and conditions of these Rules, as specified in the contract for the supply of natural gas to household consumers. There are no additional costs for providing information to the residential consumer;
  • publish on the website (and in the mass media where required by law) detailed information on changes in the price of natural gas five days before its entry into force;
  • issue to the consumer free of charge settlement books with receipt forms, payment documents and application forms;
  • to consider, in the prescribed manner, the claims of a household consumer regarding charges for consumed natural gas, taking into account the requirements of paragraph 9 of Section VI of these Rules and, if there are appropriate grounds, to satisfy his requirements;
  • ensure the proper organization of their own work to be able to transfer and process the consumer's appeal on issues related to the implementation of the supply contract;
  • to accept payment for the services provided by any of the methods provided for in the supply agreement;
  • compensate for losses incurred by the consumer in the event of non-fulfillment or improper fulfillment by the supplier of its obligations under the supply agreement;
  • inform the consumer about the conditions for the guaranteed supply of natural gas by the supplier, which, in accordance with the procedure established by law, is entrusted with special obligations for the supply of natural gas to household consumers;
  • ensure the confidentiality of data received from the consumer;
  • within three days from the date when the supplier became aware of the inability to extend the supply of natural gas to the consumer, he undertakes to inform the consumer of his right:
  • choose another provider and the consequences of not doing so;
  • to go to the supplier, who is assigned special obligations in accordance with the established procedure (if any), who does not have the right to refuse the consumer to conclude a contract for the supply of natural gas;
  • for compensation for damage caused due to the impossibility of the supplier to further fulfill its obligations under the supply agreement;
  • ensure the submission of all necessary documents to confirm by the gas transmission system operator the volume of natural gas required by the consumer, provided that the consumer has fulfilled its own obligations to the supplier for ordering the volume of natural gas required by the consumer;
  • Notify the consumer in a timely manner if the supplier is in the process of being liquidated or declared bankrupt, or the supplier is undergoing the suspension / revocation of a natural gas supply license, or its license to carry out natural gas supply activities has been canceled or suspended and about lack of natural gas resource;
  • comply with minimum standards and requirements for the quality of service for natural gas consumers;
  • create points of contact to provide information to residential customers. Contact details and operating hours of each contact point must be provided in the application-attachment and / or contract for the supply of natural gas to household consumers and on the supplier's website on the Internet;
  • provide the final invoice to the residential consumer after changing the supplier or terminating the contract for the supply of natural gas to residential consumers no later than six weeks after such change or termination of the contract;
  • inform about the intention to change the terms of the contract for the supply of natural gas, while the consumer must be notified of his right to refuse the proposed changes. Such notice must be provided to the consumer no later than 30 days before the scheduled entry into force of such changes (except for the price of natural gas, if it is set for the supplier by the relevant government authorities);
  • Fulfill other obligations imposed on the supplier by applicable law and/or the supply agreement.

  • to receive payment from the consumer for the supplied natural gas;
  • control the correctness of the consumer's execution of payment documents;
  • initiate the termination of natural gas supplies to the consumer in the manner and on the terms determined by the supply agreement and current legislation;
  • to carry out, together with the consumer, a reconciliation of the actually used volumes of natural gas with the signing of the relevant act;
  • receive compensation from the consumer for damages incurred by the supplier due to the consumer's failure to perform or improper performance of its obligations to the supplier, in accordance with the terms of the supply agreement and applicable law;
  • conclude a contract for the supply of natural gas with any consumer and, in the absence of an overdue debt of the consumer for natural gas to the current supplier, supply natural gas to the consumer in the period following the period of natural gas supply by the current supplier;
  • unhindered access (upon presentation of an official ID) to commercial natural gas metering units installed at the consumer's gas consumption facilities to verify data on actual natural gas consumption;
  • to full and reliable information from the consumer, with whom the supply contract has been concluded, about the modes of consumption of natural gas;
  • have other rights provided for by applicable laws and regulations.
